By accessing or using our platform ("Pluk AI"), products, services, website, and applications (collectively, "Services"), you agree to comply with and be bound by the following terms and conditions (the "Terms"). Freelancers

When creating a profile on Pluk AI, freelancers are required to provide the following:

Mandatory Information:

• First Name and Last Name: To establish your identity on the platform
• Email Address: For account access and communications
• Professional Title: Your primary professional designation
• Skills and Expertise: Key competencies relevant to your freelance work
• Portfolio or Work Samples: Examples of your previous work (can be links or uploaded files)

Optional Information:

• Professional Bio: A detailed description of your experience and expertise
• Work Experience: Details about your past employment and freelance projects
• Educational Background: Information about your education and training
• Professional Certifications: Any relevant certifications that enhance your qualifications
• Hourly Rate or Project Pricing: Your standard rates for services
• Availability: Your general availability for new projects
• Time Zone: To facilitate scheduling with clients
• Languages Spoken: For international collaboration opportunities
• LinkedIn Profile: To verify professional credentials
• Additional Portfolio Links: GitHub, Behance, Dribbble, or other professional profiles

Clients

Clients on Pluk AI are required to provide comprehensive information to create effective project listings and engage with freelancers:

Mandatory Information for Client Profile:

• Contact Name: The primary contact person
• Company Name: The legal name of your company (if applicable)
• Email Address: For account access and communications
• Industry/Business Type: The sector your business operates in

Mandatory Information for Project Postings:

• Project Title: A clear title for the work needed
• Project Description: Detailed description of the project scope and requirements
• Budget Range: The budget allocated for the project
• Project Timeline: Expected start date and deadline
• Required Skills: The specific skills needed for the project

Subscription and Billing

For Freelancers:

• Basic account creation is free
• Premium features may be available for a monthly subscription fee
• Commission fees may apply to completed projects (percentage to be determined)

For Clients:

• Account creation is free
• Service fees apply to successful project completions
• Premium features for enhanced visibility and project management may be available

Account Security

You will not share your account or password with anyone, and you must protect the security of your account and your password. You are solely responsible for any and all activity associated with your account.

2. Content Guidelines

All content must be professional and appropriate for a business environment. You represent, warrant, and agree that you will not publish any inappropriate content on Pluk AI or using the Services. Inappropriate content includes but is not limited to:

• Explicit Material: Content that includes nudity, sexual acts, or explicit imagery
• Violent or Graphic Content: Images or descriptions that depict violence, gore, or other graphic material
• Hate Speech and Discrimination: Language or imagery that promotes hatred, discrimination, or violence against individuals or groups based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or other protected categories
• Harassment and Bullying: Content that intimidates, demeans, or harasses individuals or specific groups of people
• False Information and Misrepresentation: Deliberately misleading or fraudulent information, fake credentials, or impersonation of individuals or organizations
• Illegal Activities: Promotion of illegal activities or content that violates laws and regulations
• Spam and Malware: Unsolicited promotions, commercial messages unrelated to freelance services, or content that contains harmful software
• Intellectual Property Violations: Content that infringes, violates, or misappropriates the intellectual property rights of any other person
• Non-Professional Content: Content unrelated to professional services, freelancing, or business collaboration

3. Platform Usage and Communication

Acceptable Use

Pluk AI is designed exclusively for connecting freelancers with clients for professional services. All platform usage must align with this purpose.

Permitted Uses:

• Posting and applying for freelance projects
• Showcasing professional portfolios and work samples
• Negotiating project terms and timelines
• Collaborating on project deliverables
• Providing and receiving professional feedback
• Building professional networks
• Sharing industry insights and knowledge

4. Project Management and Payments

Project Workflow

1. Project Posting: Clients post detailed project requirements
2. Proposals: Freelancers submit proposals with timelines and budgets
3. Selection: Clients review proposals and select freelancers
4. Agreement: Both parties agree to project terms through the platform
5. Work Phase: Freelancers complete work with milestone check-ins
6. Delivery: Final deliverables are submitted through the platform
7. Payment: Clients approve work and payment is processed
8. Feedback: Both parties can leave reviews

5. Intellectual Property

Ownership of Work Product

Unless otherwise agreed in writing between the client and freelancer:

• Work-for-Hire: Completed work becomes the property of the client upon full payment
• Portfolio Rights: Freelancers may display completed work in their portfolios unless prohibited by confidentiality agreements
• Pre-existing IP: Freelancers retain rights to their pre-existing intellectual property, tools, and methodologies

6. Privacy and Data Security

7. AI Services and Limitations

AI-Powered Features

Pluk AI utilizes artificial intelligence and machine learning technologies to provide various services, including but not limited to:

• Matching freelancers with opportunities
• Generating project recommendations
• Drafting communications and emails
• Providing project insights and suggestions
• Automated responses and notifications
• Profile optimization recommendations

Your Responsibilities When Using AI Features:

• Always review and verify AI-generated content before using it
• Double-check recipient information before sending AI-drafted communications
• Verify the accuracy of any AI-provided information or recommendations
• Maintain human oversight over all critical decisions

By using our AI features, you acknowledge that Pluk AI is not liable for any errors, omissions, inaccuracies, or unintended consequences resulting from AI-generated content or actions. You use AI features at your own risk.

8. Third-Party Opportunities and Disclaimers

External Opportunities

Pluk AI may present freelance opportunities from various sources, including third-party job boards, client postings, and external platforms. IMPORTANT DISCLAIMER:

Your Responsibility: You are solely responsible for:

• Conducting your own due diligence on all opportunities
• Verifying the legitimacy of clients and projects
• Reviewing and understanding all contract terms
• Protecting yourself from scams or fraudulent activities
• Ensuring payment terms are secure before beginning work
• Complying with all applicable laws and regulations

By using our Services, you acknowledge that you proceed with any opportunity at your own risk and that Pluk AI is not responsible for any losses, damages, or negative outcomes resulting from opportunities presented on or through our platform.

9. Liability and Indemnification

Platform Role

Pluk AI operates as an AI-powered marketplace and opportunity aggregator connecting independent freelancers with potential clients. We are not:

• The employer of any freelancer
• Responsible for verifying the legitimacy of opportunities
• Responsible for the quality of work delivered
• Liable for project outcomes or user interactions
• Responsible for tax withholdings or employment benefits
• Guarantors of payment or contract fulfillment
• Liable for AI errors, hallucinations, or incorrect actions
• Responsible for consequences of AI-generated content or communications

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLUK AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES. THIS INCLUDES, BUT IS NOT LIMITED TO, DAMAGES ARISING FROM AI ERRORS, INCORRECT AUTOMATED ACTIONS, MISCOMMUNICATIONS, OR ANY RELIANCE ON AI-GENERATED CONTENT.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email notification, platform announcement, or website banner. Continued use of the platform after changes constitutes acceptance of the modified Terms.
